1. General provisions
This document is a public offer (proposal) by the owner of the website smart-brains.ru, taxpayer ID (INN) 166017443612 (self-employed, a payer of the professional income tax) (the “provider”), to conclude an agreement for access to the Smart Brains online trainers (the “agreement”) on the terms set out below, in accordance with articles 435 and 437 of the Civil Code of the Russian Federation.
Payment for the chosen plan constitutes acceptance of the offer. From the moment of acceptance the agreement is considered concluded, and the person who paid for the plan (the “customer”) is considered to have accepted all terms of the offer.
2. Subject of the agreement
For the paid period, the provider gives the customer access to the Smart Brains service — online trainers on the website smart-brains.ru and in the Telegram bot @SmartBrainsTrainerBot — within the scope of the chosen plan.
The exercises train skills in game form and are not a medical, psychological or educational service.
3. Plans and prices
Free: the daily workout and 10 minutes of play a day, all trainers and collections.
Paid plans give unlimited play time, full history and the progress chart:
- 1 month — 299 rubles;
- 3 months — 799 rubles;
- 12 months — 3,099 rubles.
Current plans and prices are published in the “Pricing” section on the website’s home page. The provider may change the plans; a change does not affect a period that has already been paid for.
4. Payment
Payment is made in rubles through the payment services connected on the website, and in the Telegram bot also in Telegram Stars at the rate shown at the time of payment. The customer’s payment obligation is considered fulfilled once the funds are received by the provider. The provider issues a receipt in the “Moy Nalog” (“My Tax”) app in accordance with Russian Federal Law No. 422-FZ of November 27, 2018 and sends it to the customer’s email address.
5. Granting access
Access under the paid plan opens automatically after the payment is received, in the account from which the payment was made, and lasts until the end of the paid period. If access has not opened within 24 hours, the customer notifies the provider by email.
6. Refunds
The customer may withdraw from the agreement at any time by sending the provider a request by email from the address specified in the account. The provider refunds the cost of the unused access period (in proportion to the remaining full days) within 10 business days using the same method by which the payment was made, unless the rules of the payment service provide otherwise.
7. Liability
The service is provided “as is”. The provider does not guarantee that the customer will achieve any results from the practice. The provider is not responsible for interruptions in the service caused by the actions of third parties, failures of communication lines or of the customer’s equipment. If the service is interrupted through the provider’s fault for more than 24 hours in a row, the paid access period is extended by the length of the interruption.
8. Other terms
The terms of use and the personal data processing policy apply to the relationship between the parties. Disputes are resolved through negotiation and, failing agreement, in the manner established by the laws of the Russian Federation.
